What is the H-1B Visa

  • The H-1B is a 3-year temporary working visa – that can be extended for another 3 years.
  • A US Company can hire highly educated foreign professionals to work in “specific jobs”
  • Applicants require at least a bachelor’s degree or the equivalent.
  • The U.S. Congress limits the number of H-1B visas to 65,000 visa applicants a year
  • There are a further 20,000 visas for foreign professionals who graduate with a Master’s Degree or Doctorate from a U.S. University.
  • This is a very popular visa and is oversubscribed EVERY year – registration is really a ‘lottery’
  • There is a 1:3 chance your application will get chosen within the 65,000 per year.
  • You must register BEFORE the deadline
Registering for the H-1B visa

Each year, the US Immigration announces the registration period with a March 30th DEADLINE, but each year is different.

The EMPLOYER must electronically register the overseas applicant for their H-1B petition during the registration period to enter this visa “lottery” to hopefully get to apply for the H-1B visa.

If your candidate is chosen, you, as their future employer, have 90 days to submit the H-1B visa application.

1st October of the next fiscal year is the start date of employment. (if submitting on 30 March 2023, the start date for employment will be 1 October 2023)

One important note is that the Spouse of the H-1B applicant is not permitted to work throughout their stay in the US.
